PixelFit Terms of Service

1. Introduction and Agreement to Terms

Welcome to PixelFit! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and ALMAREN LABS LLC, a Delaware limited liability company located at 8 The Green, STE 23103, Dover, DE 19901, USA ("Company", "we", "us"). These Terms govern your access to and use of the PixelFit mobile application, its companion smartwatch application, and related services (collectively, the "Service").

PixelFit is a step-tracking application in which your daily physical activity advances a pixel-art character. By registering an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Age Requirements

The Service is intended for users who are at least 16 years old. We set this limit because using PixelFit requires you to give explicit consent to the processing of health-related data (your step count and activity sessions), and in several jurisdictions a person under 16 cannot give that consent on their own.

We do not ask for or store your date of birth, so we cannot verify your age; we rely on your statement that you meet this requirement. If we learn that an account belongs to someone under 16, we will close it and delete the associated data.

If you are 16 or older but under the age of legal majority in your jurisdiction, you should use the Service with the knowledge and agreement of a parent or legal guardian.

3. Health and Fitness Disclaimer

PixelFit is not a medical application and is not a medical device. The Service counts steps, records the duration of activity sessions you start, and displays estimates derived from that data (such as distance and approximate calories). These figures are approximations for motivational and lifestyle purposes only. They are not measurements, not diagnoses, and not medical advice.

Where the companion Wear OS watch application is used and the watch makes a heart rate reading available, PixelFit displays it on the watch during an activity session as an on-screen indicator only. It is not evaluated, interpreted, stored, or used for any health assessment.

Step counts and other activity figures depend on sensors and platform services outside our control and may be inaccurate or incomplete. You should consult a qualified healthcare provider before starting any new exercise program. The Company disclaims all liability for any physical injury, health complication, or damages resulting from your reliance on the Service. You use the Service entirely at your own risk.

4. User Account and Security

To use the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials. We use secure cryptographic methods to protect your passwords and session data. If you suspect unauthorized access, contact us immediately at info@almarenlabs.net.

You may choose a display name. You may not choose a name that is offensive, impersonates another person, or infringes the rights of others; we may reset such names.

5. Companion Smartwatch Application (Android only)

PixelFit includes an optional application for Wear OS smartwatches. It is available only to users of the Android version of PixelFit; there is no companion watch application for iOS, and the features described in this section — including the on-screen heart rate indicator — are not part of the iOS version of the Service.

The watch application displays your character, level, step count, and activity statistics, and lets you start and end activity sessions from your wrist.

The watch application does not connect to our servers. It receives its data from the PixelFit application on your paired phone and shows the most recently received state, including when it is offline. Pairing works only between a phone and a watch on which the same PixelFit application is installed.

6. In-Game Progress and Virtual Coins

The Service includes virtual items and a virtual currency ("Coins") that you earn through activity within the app.

Coins and virtual items have no monetary value, are not property, and cannot be sold, transferred, exchanged, or redeemed for money or anything of value outside the Service. They are a limited, revocable, personal licence to use a feature of the Service, and they expire when your account is closed.

We may adjust game balance — including how Coins are earned, what items cost, and how progression works — in order to operate the Service. We do not owe compensation for such adjustments. We may reverse Coins, items, or progress obtained through error, exploitation, automation, or falsified activity data.

You may not use automated tools, emulators, or modified software to generate activity data or otherwise obtain progress you did not earn through genuine physical activity.

7. Third-Party Services

The Service uses third-party providers for core functions, including cloud hosting (located in the European Union) and transactional email delivery. Activity data is read, with your permission, from the platform on your device: on Android from Android Health Connect, and on iOS from the device's own motion and fitness sensors. Apple Inc. and Google LLC distribute the app through their stores and are third-party beneficiaries of these Terms; see also section 12.

PixelFit does not display advertising and does not offer in-app purchases. If either is introduced in the future, these Terms and our Privacy Policy will be updated before that feature is released, and any consent required by law will be requested separately.

8. Account Deactivation, Termination and Data Deletion

Deactivating (closing without deleting). The app also offers Settings -> Account -> Deactivate Account. Deactivation signs you out, ends all of your sessions, and blocks further sign-in, but it does not delete your data: your account and progress remain stored on our servers so that the account can be restored if you ask us to. A deactivated account is kept until you request deletion or reactivation. Deactivation does not withdraw the consent you gave for your activity data; if that is what you want, delete the account instead. To have your account reopened, write to info@almarenlabs.net from the email address registered to the account. If you want your data removed rather than kept, use deletion instead of deactivation.

Deleting (permanent). You can terminate this agreement at any time by deleting your account. Go to Settings -> Account -> Delete Account within the app. You will need to confirm with your password. Upon successful deletion, your session will end and your account data will be removed from our active systems. Deletion also removes your character progress, Coins, and virtual items; this cannot be undone. For detailed steps, visit: https://www.almarenlabs.net/pixelfit/account-deletion

We also reserve the right to suspend or terminate your account if you violate these Terms.

9. Intellectual Property

All software, designs, pixel artwork, characters, text, graphics, and algorithms associated with the Service are the proprietary property of ALMAREN LABS LLC. You are granted a limited, personal, non-commercial license to use the app.

10. Limitation of Liability

To the maximum extent permitted by law, ALMAREN LABS LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. To the extent permitted by the mandatory laws of your country of residence (including applicable consumer protection rules you cannot contractually waive), you agree that the state and federal courts located in Delaware, USA, shall have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. If mandatory law requires a different forum for consumers in your country, that law will apply to that extent.

12. Additional Terms for Applications Downloaded from the Apple App Store

The following terms apply only if you obtained PixelFit from the Apple App Store, and they apply in addition to the rest of these Terms.

Acknowledgement. These Terms are concluded between you and ALMAREN LABS LLC only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for PixelFit and its content.

Scope of licence. The licence granted to you in section 9 is limited to a non-transferable licence to use PixelFit on any Apple-branded product that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

Maintenance and support. We are solely responsible for providing any maintenance and support for PixelFit. Apple has no obligation whatsoever to furnish any maintenance or support services.

Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If PixelFit fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you (PixelFit is currently distributed free of charge). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to PixelFit.

Product claims. We, not Apple, are responsible for addressing any claims relating to PixelFit or your possession and use of it, including but not limited to product liability claims, any claim that PixelFit fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Intellectual property claims. In the event of any third-party claim that PixelFit or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.

Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms. You must comply with any applicable third-party terms of agreement when using PixelFit — for example, your wireless data service agreement.

Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
