FitCheck Terms of Service

1. Introduction and Agreement to Terms

Welcome to FitCheck! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and ALMAREN LABS LLC, a Delaware limited liability company located at 8 The Green, STE 23103, Dover, DE 19901, USA ("Company", "we", "us"). These Terms govern your access to and use of the FitCheck mobile application, web client, and related fitness, nutrition, and community services (collectively, the "Service").

By registering an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Age Requirements

The Service is intended for users who are at least 18 years old or the age of legal majority in your jurisdiction. If you are a minor, you must have the explicit consent of a parent or legal guardian to use the Service. We reserve the right to suspend accounts if age compliance cannot be verified.

3. Medical and Fitness Disclaimer

FitCheck is not a medical application. The Service provides algorithmic fitness targets, macronutrient templates, workout routines, and calculators (such as BMI and BMR) for informational and lifestyle purposes only.

The Service does not account for hidden medical conditions, allergies, or specific physiological anomalies. You should always consult with a qualified healthcare provider or physician before starting any new diet or exercise program. The Company disclaims all liability for any physical injury, health complication, or damages resulting from your reliance on the Service. You use the Service entirely at your own risk.

4. User Account and Security

To use the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials. We use secure cryptographic methods to protect your passwords and session data. If you suspect unauthorized access, contact us immediately at info@almarenlabs.net.

5. User-Generated Content (UGC) and Moderation

FitCheck includes community features allowing you to post threads, replies, profile pictures, and file attachments ("UGC"). In strict compliance with App Store and Google Play guidelines, we maintain a zero-tolerance policy for objectionable content.

Prohibited Content: You may not post content that is illegal, abusive, harassing, defamatory, sexually explicit, infringes on intellectual property, or contains malicious code.

Moderation & Reporting: We actively moderate UGC. Users can flag inappropriate content and block abusive users directly within the app.

Enforcement: We reserve the right to remove any content and permanently suspend or ban accounts that violate these rules, without prior notice.

By posting UGC, you grant us a license to host, display, and distribute that content solely to operate the Service.

6. Subscriptions and In-App Purchases

FitCheck offers optional paid subscriptions. Core features of the Service remain available without payment.

Plans. Paid plans unlock benefits such as an ad-free experience and higher limits on the number of custom workout and nutrition plans you can save. The benefits and limits of each plan are displayed inside the app before purchase.

Billing and auto-renewal. Subscriptions are offered on a monthly or annual basis. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions renew automatically at the same price and interval unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. The current price, billing period, and renewal terms are always shown on the purchase screen before you confirm.

Managing and cancelling. Your subscription is managed by Apple or Google, not by us. You can turn off auto-renewal or cancel at any time in your Apple ID or Google Play account settings. We cannot cancel a subscription on your behalf. Cancelling stops future renewals; you keep access until the end of the period you already paid for.

Refunds. Purchases are processed by Apple and Google. Refund requests are handled by them under their own policies, and we are not able to issue refunds directly. We will assist where we can, but the decision rests with the store.

Price changes. If we change the price of a subscription, the new price will not apply to your current billing period. Apple and Google will notify you and, where their rules require it, ask for your consent before charging a higher price. If you do not agree, you may cancel before the change takes effect.

What happens when a subscription ends. We do not delete content you have already created. If your plan limit is lower than the number of items you currently have, your existing plans remain accessible; you simply cannot create new ones until you are below the limit of your current plan.

Free plan. Where a benefit is included in a paid plan (for example, the removal of advertising), that benefit applies only while the subscription is active.

7. Third-Party Services

The Service utilizes third-party providers for core functions, including cloud hosting (located in the European Union) and transactional email delivery. Some workout content may include embedded videos (e.g., via YouTube), which are subject to their respective third-party terms. Apple Inc. and Google LLC are third-party beneficiaries of these Terms if you downloaded the app from their stores.

Advertising. The free plan is supported by advertising served by third-party advertising networks. We do not control, endorse, or take responsibility for the content of those advertisements or for the products and services they promote. Any dealing you have with an advertiser — including purchases, offers, and any terms they present — is solely between you and that advertiser. 8. Account Termination and Data Deletion

You can terminate this agreement at any time by deleting your account. Go to Profile -> Account Settings -> Delete Account within the app. You will need to confirm with your password. Deleting your account does not cancel your subscription. Your subscription is billed and managed by Apple or Google, and it will continue to renew even after your FitCheck account is gone. Cancel it separately in your Apple ID or Google Play account settings before or after deleting your account.

We also reserve the right to suspend or terminate your account if you violate these Terms.

9. Intellectual Property

All software, designs, text, graphics, and algorithms associated with the Service are the proprietary property of ALMAREN LABS LLC. You are granted a limited, personal, non-commercial license to use the app.

10. Limitation of Liability

To the maximum extent permitted by law, ALMAREN LABS LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. To the extent permitted by the mandatory laws of your country of residence (including applicable consumer protection rules you cannot contractually waive), you agree that the state and federal courts located in Delaware, USA, shall have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. If mandatory law requires a different forum for consumers in your country, that law will apply to that extent.
