1. Introduction and Agreement to Terms

Welcome to FitCheck! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and ALMAREN LABS LLC, a Delaware limited liability company located at 8 The Green, STE 23103, Dover, DE 19901, USA ("Company", "we", "us"). These Terms govern your access to and use of the FitCheck mobile application, web client, and related fitness, nutrition, and community services (collectively, the "Service").

By registering an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Age Requirements

The Service is intended for users who are at least 18 years old or the age of legal majority in your jurisdiction. If you are a minor, you must have the explicit consent of a parent or legal guardian to use the Service. We reserve the right to suspend accounts if age compliance cannot be verified.

3. Medical and Fitness Disclaimer

FitCheck is not a medical application. The Service provides algorithmic fitness targets, macronutrient templates, workout routines, and calculators (such as BMI and BMR) for informational and lifestyle purposes only.

The Service does not account for hidden medical conditions, allergies, or specific physiological anomalies. You should always consult with a qualified healthcare provider or physician before starting any new diet or exercise program. The Company disclaims all liability for any physical injury, health complication, or damages resulting from your reliance on the Service. You use the Service entirely at your own risk.

4. User Account and Security

To use the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials. We use secure cryptographic methods to protect your passwords and session data. If you suspect unauthorized access, contact us immediately at info@almarenlabs.net.

5. User-Generated Content (UGC) and Moderation

FitCheck includes community features allowing you to post threads, replies, profile pictures, and file attachments ("UGC"). In strict compliance with App Store and Google Play guidelines, we maintain a zero-tolerance policy for objectionable content.

Prohibited Content: You may not post content that is illegal, abusive, harassing, defamatory, sexually explicit, infringes on intellectual property, or contains malicious code.

Moderation & Reporting: We actively moderate UGC. Users can flag inappropriate content and block abusive users directly within the app.

Enforcement: We reserve the right to remove any content and permanently suspend or ban accounts that violate these rules, without prior notice.

By posting UGC, you grant us a license to host, display, and distribute that content solely to operate the Service.

6. Third-Party Services

The Service utilizes third-party providers for core functions, including cloud hosting (located in the European Union) and transactional email delivery. Some workout content may include embedded videos (e.g., via YouTube), which are subject to their respective third-party terms. Apple Inc. and Google LLC are third-party beneficiaries of these Terms if you downloaded the app from their stores.

7. Account Termination and Data Deletion

You can terminate this agreement at any time by deleting your account. Go to Profile -> Account Settings -> Delete Account within the app. You will need to confirm with your password. We also reserve the right to suspend or terminate your account if you violate these Terms.

8. Intellectual Property

All software, designs, text, graphics, and algorithms associated with the Service are the proprietary property of ALMAREN LABS LLC. You are granted a limited, personal, non-commercial license to use the app.

9. Limitation of Liability

To the maximum extent permitted by law, ALMAREN LABS LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. To the extent permitted by the mandatory laws of your country of residence (including applicable consumer protection rules you cannot contractually waive), you agree that the state and federal courts located in Delaware, USA, shall have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. If mandatory law requires a different forum for consumers in your country, that law will apply to that extent.
